Terms & Conditions for Business Listings

Effective Date: 01 April 2025

WeHalaal.com  & WeHalaal Mobile Application ("the Platform") is a community-driven digital map and directory service that highlights Halaal-certified and Muslim-owned businesses. In keeping with our mission to support integrity, transparency, and Islamic values, all business owners who submit their enterprises to be listed on our platform must agree to and comply with the following comprehensive Terms and Conditions.

1. DECLARATION OF HALAAL STATUS

1.1 By submitting a business to WeHalaal.com for listing, you, the applicant ("the Business"), solemnly affirm that your business is either:

Halaal certified by a recognised authority, or

Owned and operated by a Muslim who adheres to Islamic dietary laws in the preparation, production, and sale of all goods and services presented on the platform.

1.2 You further confirm that all products, ingredients, or services provided by your business are compliant with the tenets of Halaal as prescribed by Islamic jurisprudence.

1.3 The Platform operates under the assumption that each applicant is submitting their business in good faith and with a clear conscience. As such, WeHalaal.com accepts your submission as a binding declaration of truth and reserves the right to remove your listing if evidence to the contrary arises.

1.4 If any false claim is made regarding the Halaal status or Muslim ownership of the business, the applicant acknowledges that the spiritual, moral, and legal responsibility lies entirely with them. WeHalaal.com shall bear no responsibility in this regard, and any misrepresentation is ultimately a matter between the business and their Creator.

2. PLATFORM’S ROLE AND LIABILITY DISCLAIMER

2.1 WeHalaal.com is a listing directory only. We do not operate as a seller, broker, agent, intermediary, or regulator.

2.2 WeHalaal.com does not:

Sell, distribute, or deliver any products or services

Process payments on behalf of any listed businesses

Guarantee the quality, safety, legality, or Halaal compliance of any goods or services offered

Endorse or verify the operational practices of businesses listed on the map

2.3 Users who access and interact with listings on the platform do so entirely at their own discretion and risk.

2.4 You acknowledge and agree that WeHalaal.com shall not be held liable for any claim, loss, damage, or dispute resulting from a business's activities, operations, or interactions with customers.

3. ACCURACY OF INFORMATION

3.1 All information provided by the business—including but not limited to name, description, services, pricing, imagery, contact details, and location—is the sole responsibility of the applicant.

3.2 By submitting your listing, you affirm that all information is complete, truthful, accurate, and up-to-date.

3.3 You further agree to notify WeHalaal.com immediately of any changes in:

Ownership or management

Halaal certification status

Contact details or operating hours

Any other information previously submitted

3.4 Failure to update your listing may result in the removal of your business from the platform without prior notice.

4. LISTING APPROVAL, MODERATION & REMOVAL

4.1 Submitting a business to WeHalaal.com does not guarantee approval. Listings are curated and published at the sole discretion of the Platform.

4.2 WeHalaal.com reserves the right to:

Accept or reject submissions without explanation

Edit descriptions for formatting or consistency

Remove any listing at any time, especially if complaints or concerns arise regarding the authenticity of Halaal claims or the business’s conduct

4.3 Businesses found to have misrepresented themselves or who engage in conduct that is unethical, misleading, or non-compliant with Islamic principles may be permanently banned from the platform.

5. SUBSCRIPTION & FEATURED LISTINGS (IF APPLICABLE)

5.1 Businesses may be offered the option to subscribe to premium features such as:

Featured listings on the Billboard section

Promotional placements

Extended map visibility

5.2 Pricing structures for these services will be made available on the relevant checkout or application pages.

5.3 Subscriptions are non-refundable and subject to periodic changes with a minimum 30-day notice.

6. USER CONDUCT & COMMUNITY TRUST

6.1 WeHalaal.com is a project built on community trust, Islamic values, and the spirit of mutual benefit.

6.2 Business owners are expected to uphold the highest standards of integrity and customer service, especially in the context of Halaal representation.

6.3 You agree not to:

Mislead customers regarding Halaal status

Promote haram (forbidden) products, services, or imagery

Engage in any illegal, deceptive, or harmful activities using the platform

7. SPIRITUAL ACCOUNTABILITY & ETHICAL GUIDELINES

7.1 The act of submitting your business to WeHalaal.com is a declaration made in front of Allah (SWT) and your community.

7.2 If you falsely claim to be Halaal-certified or Muslim-owned while not meeting the religious requirements of either, you bear:

Full moral and spiritual responsibility for any deception

Legal accountability for any damages caused

Personal liability for misleading consumers who trust the WeHalaal.com platform

7.3 WeHalaal.com reminds applicants that deceit in matters of religion and commerce is gravely serious in Islamic law. We encourage all businesses to uphold honesty, transparency, and accountability in all affairs.

8. INDEMNITY

You agree to indemnify, defend, and hold harmless WeHalaal.com, its owners, affiliates, team members, and agents from any claim, liability, damage, loss, or expense (including legal fees) arising out of:

Your use of the platform

Your listing and its content

Any misrepresentation or false claim you make

Any legal disputes or complaints brought against your business

9. INTELLECTUAL PROPERTY

9.1 All designs, logos, layouts, text, and branding related to WeHalaal.com are the intellectual property of the Platform and may not be reproduced without express written consent.

9.2 You may not use WeHalaal.com’s branding to imply endorsement or partnership unless you have explicit written permission.

9.3 Data Protection and Prohibited Use of Platform Content
9.3.1 All business listings, including but not limited to descriptions, contact details, imagery, and geographical information appearing on the WeHalaal.com website or mobile applications, form part of the proprietary database of WeHalaal.com.
9.3.2 You acknowledge and agree that such information is made available exclusively for the purpose of user discovery and engagement within the WeHalaal ecosystem, and may not be copied, extracted, reproduced, or republished, whether manually or through automated means (including data scraping, screen capturing, or digital duplication).
9.3.3 Any unauthorized use, redistribution, or replication of listings, images, or structured data from the platform — whether in part or in full — constitutes a breach of these Terms and may result in legal action.
9.3.4 By submitting a listing or accessing the platform, you expressly acknowledge that all data, presentation formats, and compilation methods constitute proprietary and confidential assets of WeHalaal.com and are protected under applicable intellectual property and data protection laws of the Republic of South Africa.

LISTING FEES, VISIBILITY TERMS & REFUND POLICY

10.1 All listing fees for WeHalaal map visibility are fixed, upfront charges payable before a pin is activated on the Platform.

10.2 The available visibility terms include, but are not limited to:

A 6-month visibility term, currently priced at R380, and

A 12-month visibility term, currently priced at R590.

10.3 Each visibility term represents a full access entitlement range, not a minimum duration. Accordingly:

The 6-month term expressly covers any period from zero (0) to six (6) months; and

The 12-month term expressly covers any period from zero (0) to twelve (12) months.

10.4 If a business requests early removal of its pin—for example, where a rental property is leased sooner than expected or a business discontinues operations—no refunds, pro-rated amounts, credits, or partial reimbursements will be issued under any circumstance.

10.5 Once payment is made and the listing is activated on the map, the full fee is deemed earned in advance, irrespective of how long the pin remains live during the purchased term.

10.6 WeHalaal.com reserves the unrestricted right, at its sole discretion, to modify, increase, decrease, or restructure listing fees or packages at any time. Any changes will apply to future purchases only and will not affect terms already paid for.

11. GOVERNING LAW

These terms and conditions are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Gauteng Province under South African legal jurisdiction.

12. ACCEPTANCE

By checking the acknowledgment box during your application and submitting your business details, you:

Confirm that you have read and fully understood these Terms and Conditions

Accept that your listing is contingent upon truthfulness and ongoing compliance

Waive any rights to hold WeHalaal.com accountable for damages or losses resulting from your business listing or its removal

May Allah (SWT) bless your business with barakah, sincerity, and success.

Welcome to WeHalaal.com. By accessing or using our platform (including our website, mobile applications, and any affiliated services), you agree to be bound by the following Terms and Conditions. Please read them carefully before proceeding.

1. Acceptance of Terms

2. Description of Service

WeHalaal.com is a digital platform that:

Provides users with a map-based directory of Halaal businesses, including but not limited to home industries, restaurants, retailers, services, and events.

Allows business owners to submit listings for inclusion on the platform.

Offers limited advertising and promotional services through designated sections such as the Billboard.

Note: We do not sell any products or services directly. All transactions, engagements, or purchases made through businesses listed on WeHalaal.com are solely between the user and the business.

3. User Responsibilities

As a user of WeHalaal.com, you agree to:

Use the platform only for lawful and appropriate purposes.

Not misuse, modify, or reverse-engineer any part of the platform.

Respect the privacy, intellectual property, and religious sensitivities of others.

Acknowledge that all listings are provided “as-is,” and you are solely responsible for verifying the authenticity, safety, and suitability of the business you choose to engage with.

4. Content Accuracy & Business Representation

While we take stringent steps to ensure listings are relevant and appropriate:

We do not independently guarantee the Halaal status, quality, licensing, hygiene, or conduct of any listed business after due-diligence & on-boarding is complete.

The Halaal status of a business is self-declared by the business owner. WeHalaal.com makes no religious, legal, or ethical guarantees in this regard.

You agree to use your discretion, judgment, and where necessary, seek clarification or certification directly from the business in question.

5. Limitation of Liability

To the fullest extent permitted by law:

WeHalaal.com, its owner(s), affiliates, or employees shall not be held liable for any loss, injury, harm, or dissatisfaction arising from your use of the platform or from any dealings with businesses listed herein.

We are not responsible for food allergies, dietary issues, fraud, misleading claims, or false representation by listed businesses.

The inclusion of a business on our platform does not constitute endorsement, approval, or recommendation.

6. Religious Disclaimer

WeHalaal.com is built on Islamic values and intended to serve the Muslim community. However:

We do not certify any establishment as Halaal. This is solely the responsibility of the business owner.

Users are advised to perform their own due diligence if Halaal compliance is of concern.

WeHalaal.com holds no spiritual liability for a user’s or business’s choices, claims, or practices.

7. Privacy Policy

By using our platform, you also consent to our Privacy Policy. We collect basic usage data to improve user experience. We do not sell user data to third parties. Please refer to our Privacy Policy for detailed information on how your data is collected and managed.

8. Intellectual Property

All content, branding, design, logos, and text on WeHalaal.com are the intellectual property of WeHalaal (unless otherwise credited). Users may not reproduce, repurpose, or distribute our material without explicit written consent.

9. Data Ownership, Fair Use, and Prohibition of Information Extraction

9.1 All data, listings, imagery, coordinates, business descriptions, and related content displayed on the WeHalaal.com website or mobile applications remain the property of WeHalaal.com.
9.2 Users are granted a limited, non-transferable, and revocable license to access the platform solely for personal and non-commercial use.
9.3 You may not copy, capture, extract, reformat, or otherwise repurpose any data, content, or design elements from the platform — including but not limited to map data, listings, and visual layouts — without the express written consent of WeHalaal.com.
9.4 The use of automated systems (such as web crawlers, bots, or scripts) to gather, replicate, or harvest information from the website or app is strictly prohibited.
9.5 Any individual, entity, or competitor found misusing, duplicating, or republishing WeHalaal’s information in any form shall be subject to immediate suspension of access and potential civil or criminal proceedings under South African law.
9.6 By using the platform (whether on web or mobile), you acknowledge that:

You are bound by this restriction, and

You undertake not to reuse, redistribute, or commercially exploit any information obtained from WeHalaal.com.

10. Platform Modifications and Termination

We reserve the right to:

Modify, suspend, or discontinue any aspect of the platform at any time without notice.

Restrict access to users who violate these Terms or engage in suspicious, harmful, or abusive behavior.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or relating to the use of the platform shall be subject to the exclusive jurisdiction of South African courts.

12. Changes to Terms

WeHalaal.com may amend these Terms at any time. It is your responsibility to review them periodically. Continued use of the platform constitutes acceptance of any changes made.

WeHalaal.com Billboard – Advertiser Terms and Conditions

Welcome to WeHalaal.com. These Terms and Conditions govern the use of the WeHalaal.com Billboard Advertising Platform by individuals, businesses, or organizations (collectively referred to as “Advertisers”) who wish to post advertisements, promotions, listings, or other marketing materials (“Content”) on the Billboard feature of our website.

1. General Overview

WeHalaal.com is a platform designed to showcase and support Muslim-owned and Halaal-compliant businesses and events. The Billboard feature provides advertisers with a space to promote products, services, events, and initiatives for a specified period of time at an agreed-upon fee.

2. Eligibility

To advertise on the WeHalaal.com Billboard, you must:

Be at least 18 years of age and legally capable of entering into a binding agreement.

Be the authorized representative of the business or organization you are advertising for.

Ensure that all submitted content is factually accurate, legal, and not misleading.

3. Halaal Compliance & Islamic Ethics

As a platform that caters to a predominantly Muslim audience, all Advertisers agree to the following:

Content must comply with Islamic ethics and principles, including but not limited to honesty in claims, modesty in imagery, and avoidance of content promoting haram (prohibited) products or services.

You affirm that the business, service, product, or event you are promoting is either Halaal certified or owned and operated by a Muslim, and thus accountable to Allah (SWT) regarding the truthfulness of this representation.

WeHalaal.com does not verify or certify Halaal status of Advertisers. It is the responsibility of the Advertiser to ensure the accuracy and integrity of their claim. Misrepresentation is between the Advertiser and their Creator.

4. Content Guidelines

All submissions must adhere to the following:

No offensive, vulgar, discriminatory, or hate-promoting language or imagery.

No depictions of nudity, violence, or inappropriate content.

No content that violates copyright, trademark, or any other intellectual property rights.

No political or religious propaganda not aligned with the objectives of the WeHalaal platform.

WeHalaal.com reserves the right to reject or remove any advertisement at its sole discretion without providing a reason.

5. Fees and Duration

Advertising fees are payable in advance and are non-refundable.
Duration of display on the Billboard will be based on the package selected at time of booking.
Failure to make full payment may result in the cancellation or delay of your listing.

6. Intellectual Property

By submitting content, you grant WeHalaal.com a non-exclusive, royalty-free license to use, reproduce, and publicly display the content on our platform.
You confirm that you have all necessary rights and permissions to use any logos, images, and text submitted for advertisement.

6.1 Protection of Platform Data and Advertising Content
6.1.1 All Billboard layouts, display structures, and data presentation formats are the proprietary intellectual property of WeHalaal.com.
6.1.2 Advertisers acknowledge that their published materials will appear within a secured, copyrighted platform interface that may not be copied, mirrored, or redistributed in any external directory, website, or application without written approval.
6.1.3 Unauthorized extraction, duplication, or display of advertisements or associated business data from the Billboard section shall constitute a violation of WeHalaal’s intellectual property rights and may lead to removal, account suspension, or legal recourse.

7. Limitation of Liability

WeHalaal.com shall not be held liable for any loss of revenue, reputation, or business resulting from the publication or removal of advertisements.
We do not guarantee any particular level of exposure, traffic, or sales resulting from your advertisement.
The Advertiser accepts that the platform is primarily informational, and listings do not constitute endorsements.

8. Termination and Removal

WeHalaal.com reserves the right to remove any advertisement at any time without notice if it is found to violate these terms or the spirit of the platform. No refunds will be issued under such circumstances.

9. Privacy and Data Use

We will use your business information for purposes related to listing, communication, and platform analytics. For more information, please refer to our Privacy Policy.

10. Indemnity

You agree to indemnify, defend, and hold harmless WeHalaal.com and its affiliates from any claims, damages, liabilities, and legal expenses arising from:

The content you have submitted.

Your violation of these Terms and Conditions.

Any breach of legal, ethical, or Islamic obligations in your advertisement.

11. Modifications

WeHalaal.com reserves the right to modify these terms at any time. Updated versions will be published on the platform and become effective immediately upon posting.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall fall under the exclusive jurisdiction of South African courts.

13. Notice on Information Protection

By continuing to use the WeHalaal.com website or mobile applications, you acknowledge and agree that all content, data, listings, and materials presented therein are protected intellectual property of WeHalaal.com. Any form of copying, redistribution, or reuse of such information, whether for personal, commercial, or competitive purposes, without prior written consent, is strictly prohibited and may result in prosecution under South African intellectual property and electronic communications law.

Platform Equivalence Notice

For the purposes of these Terms and Conditions, all references to “WeHalaal.com” shall be deemed to include the WeHalaal Mobile Application (Apple  & Android). Both platforms operate as one integrated service under common ownership, management, and data protection policies
